Sequences play a great role in mathematical communication. In mathematical notation, we use sequence ellipsis (. . . ) to denote "obvious" sequences like 1, 2, . . . , 7, and in conceptualizations sequence constructors like (i 2+1) i∈N. Furthermore, sequences have a prominent role as argument sequences of flexary functions. While the former cases can adequately be represented and reasoned about as domain objects in Open- Math and MathML, argument sequences are at the language level, and can only (...) be represented, but not reasoned with, since the necessary (sequence-schematic) axioms cannot be represented in the language. The myriad ways in which spatiality, or socially produced space, impinges on media texts is the overarching concern of this study. Responding to Edward Soja’s call for an assertive foregrounding of a critical spatial perspective, this article is an ontological reassertion of space in relation to news media discourse and argues that the socially constructed spatiality of a journalistic text is just as revealingly significant as its historicality and sociality. Introduced here is Critical Spatial Discourse Analysis (CSDA), a methodological framework (...) that employs the spatiocultural theory of Bill Richardson to enable a mapping of the various aspects of spatiality informing media texts. Edward Said’s imaginative geographies is also drawn upon to advance a geographical notation and mapping of the territorial imaginations underlying news media texts. The fundamental assumption of CSDA is that space is not only actively constituted in media texts but also constitutes and that it can, and indeed must be read and interpreted as any other text. A sample column from Turkey’s Sabah newspaper will be used to illustrate the application of CSDA to press coverage of democracy to see what might be revealed of those real-and-imagined spaces that are interposed and obscured in the text’s background. This article deals with the elevation of the administrative status of Jerusalem from vilāya to niyāba and the impact of this transformation on the judicial organization and the appointments in the city. During the early Mamluk period, Jerusalem remained as wilāya, a less significant administrative unit, subordinate to the nā’ib of Damascus. However, in the later eighth/fourteenth century, the city was turned into a separate niyāba, an administrative unit governed by the viceroy (nā’ib al-saltana) of the sultan, and attached directly (...) to Cairo, the political centre of the Mamluks. While the existing scholarship tends to see this change as a manoeuvre against the Crusader threat, this article argues that the foundation of niyāba in Jerusalem was associated with the bureaucratic centralisation of the Mamluk Sultanate and the religious importance of the city. Unlike the Ayyubid politics of fragmented sovereignty between the dynasty members, the Mamluks appointed viceroys on behalf of the sultan to the significant cities of Syria. Therefore, the foundation of niyāba in Jerusalem can be seen as a continuation of this attempt toward the centralisation of the Syro-Egyptian lands. On the other hand, with this change, the Mamluk sultan had the opportunity to express his patronage over Jerusalem in a more powerful way and to control the administrative, judicial, and scholarly realms in the city directly. What is more important in terms of the judicial practices is that Jerusalem was introduced to four chief judgeships (Shāfi‘ī, Hanafī, Mālikī, and Hanbalī) within the thirty-year period after the founda-tion of niyāba. All these changes meant that the city became bureaucratically more integrated with Cairo so that the Cairene elite were increasingly in-volved in local appointments of scholars. Moreover, it became increasingly crucial for Jerusalemite scholars to have connections with Cairene bureaucrats in order to secure scholarly positions in Jerusalem. (shrink)

Focused on the impact of stringent intellectual property mechanisms over the uses of plant agricultural biodiversity in crop improvement, the article delves into a systematic analysis of the relationship between institutional paradigms and their technological contexts of application, identified as mass selection, controlled hybridisation, molecular breeding tools and transgenics. While the strong property paradigm has proven effective in the context of major leaps forward in genetic engineering, it faces a systematic breakdown when extended to mass selection, where innovation often displays (...) a collective nature. However, it also creates partial blockages in those innovation schemes rested between on-farm observation and genetic modification, i.e. conventional plant breeding and upstream molecular biology research tools. Neither overly strong intellectual property rights, nor the absence of well delineated protection have proven an optimal fit for these two intermediary socio-technological systems of cumulative incremental innovation. To address these challenges, the authors look at appropriate institutional alternatives which can create effective incentives for in situ agrobiodiversity conservation and the equitable distribution of technologies in plant improvement, using the flexibilities of the TRIPS Agreement, the liability rules set forth in patents or plant variety rights themselves, and other ad hoc reward regimes. This article focuses the divorce oaths reflected in fatwās from Ottoman social life, oathbreakings and the remedies muftīs suggested to nullify divorce oaths. The purpose of the article is to describe the usage areas of the divorce oath in Ottoman social life, the problems within and outside of marriage it created, and the ways to solve these problems, based on the issues consulted to muftīs. The fatwās used as a data source in the article are limited to those have personally (...) been asked to Hanafī muftīs who served in Anatolia and Rumelia between the 16th and 18th centuries. The article is a study of the history of law that uses the fatwās in the collections, most of which are found as manuscripts, as the main data source. The acceptance of conditional divorce as a kind of oath in the Hanafī legal tradition paved the way for its use in Ottoman social life for different purposes beyond divorce. A great number of fatwās indicate that the divorce oath of husband in the family was sometimes a means of restraining and educating the wife, and sometimes a counter measure some rules of the Hanafī madhhab that may cause victimization of the wife. In social life, the divorce oath was used to reinforce personal decisions, it often functioned as a verbal guarantee in debt relations, and allowed the authorities to put pressure on people. Violation of the divorce oaths would in many cases cause serious family problems. Therefore Ottoman muftīs suggested some remedies to nullify divorce oaths. These remedies generally are proxy, marriage by unauthorized person and to divorce the wife-to break the oath-to remarry the wife. The article describes and interprets numerous fatwās on which these findings are based, in the light of Hanafī legal doctrine. (shrink)
